These Terms of Service (“Terms”) govern your use of all websites, applications, and services operated by Publisher in a Box Inc. (“PIB,” “Company,” “we,” “us,” or “our”), including publisherinabox.com and all subdomains (including but not limited to newsbomb.publisherinabox.com), APIs, dashboards, software tools, and any other digital products or services we provide (collectively, the “Services”). By accessing or using any of our Services, you agree to be bound by these Terms.
You must be at least 18 years old to use our Services. By accessing or using any part of our platform, you agree to use the Services for lawful purposes only and in compliance with all applicable laws, regulations, and platform policies.
Our offerings include, but are not limited to:
You may not copy, scrape, reverse-engineer, abuse, automate, or misuse any system, script, dashboard, API, or software provided by Publisher in a Box. You may not use our Services to violate any third-party platform’s terms of service (including Meta/Facebook, Google, or any ad exchange). Unauthorized use may result in immediate termination of access without refund.
Traffic, revenue, platform approvals, monetization outcomes, and API data availability are not guaranteed. Results vary based on content quality, niche, platform policies, algorithm changes, market conditions, and factors outside our control. Historical performance data displayed in our tools (including NewsBomb) reflects past results and does not guarantee future performance.
All Company systems, code, tools, dashboards, proprietary frameworks, proprietary methodologies, operational systems, consulting deliverables, documentation, analytics methodologies, reports, and content are owned by Publisher in a Box Inc. This includes, without limitation, all proprietary digital publishing frameworks (including the 5-Pillar Framework), diagnostic and scoring systems (including PubScore), revenue optimization systems (including Publisher Revenue Stack methodology), Generative Engine Optimization (GEO) scoring and audit methodologies, content strategy systems, scaling methodologies, and all other proprietary processes, tools, and intellectual property developed by PIB. You may not reproduce, distribute, reverse-engineer, or create derivative works from our proprietary materials without written consent. Data retrieved from your connected third-party accounts (e.g., your Facebook Content Monetization metrics) remains your data; however, the tools, interfaces, analytical frameworks, and proprietary methodologies we use to display, process, and optimize that data are our intellectual property.
Timely payment is required through approved payment processors. Access to Services may be suspended for non-payment. All fees are non-refundable unless otherwise stated in a separate written agreement. Pricing for consulting, turnkey, and SaaS services (including NewsBomb subscription tiers) is as quoted at the time of purchase and may be updated with 30 days’ notice.
Our Services depend on third-party platforms including but not limited to Facebook/Meta, Google, ad exchanges, syndication platforms, and their APIs. We have no control over their policies, availability, rate limits, data formats, or changes. We are not responsible for:
In the event that a third-party platform revokes API access or materially changes its terms in a way that prevents us from delivering a Service, we will notify you promptly and work to restore functionality or provide an alternative where feasible. This does not constitute grounds for a refund of fees already paid for services rendered.
The following additional terms apply specifically to NewsBomb and any SaaS-based dashboard or analytics tools provided by PIB:
By connecting your third-party accounts (e.g., Facebook pages) to NewsBomb or any PIB dashboard, you authorize us to access and retrieve the data specified in the platform permission flow. You represent that you have the authority to grant this access for all connected accounts.
Data displayed in NewsBomb and other PIB dashboards is retrieved from third-party APIs and is presented as-is. We do not guarantee the accuracy, completeness, or timeliness of data obtained from external platforms. Revenue figures, engagement metrics, and performance data may be subject to delays, corrections, or discrepancies between our display and the source platform’s own reporting.
We aim to maintain reasonable uptime for our SaaS tools but do not guarantee uninterrupted service. Downtime may occur due to maintenance, third-party API outages, infrastructure issues, or force majeure events. We will make reasonable efforts to notify users of scheduled maintenance in advance.
You may disconnect your third-party accounts or terminate your use of NewsBomb at any time through the dashboard settings or by contacting us. Upon disconnection, data handling follows the procedures described in our Privacy Policy (Section 6: Disconnection & Data Removal).
Publisher in a Box uses artificial intelligence (AI) tools, machine learning systems, and automated workflows (including but not limited to N8N automation, AI language models, and AI-assisted content creation tools) in the delivery of our Services. By using our Services, you acknowledge and agree that:
You retain ownership of your content and data. PIB’s use of AI tools does not transfer ownership of your content to any AI provider. Data submitted to AI tools for processing is handled in accordance with our Privacy Policy and is not used to train third-party AI models.
PIB is not liable for errors, inaccuracies, or unintended outputs produced by AI tools. While we apply human oversight and editorial standards, AI-generated content may contain errors that are corrected through our quality assurance process.
Where you use our Services to process data on behalf of your own users or audiences (e.g., turnkey page management, white-label ad-stack), you serve as the Data Controller and Publisher in a Box acts as the Data Processor. Processing is limited to service delivery, analytics, and agreed-upon purposes.
Our data processing activities are governed by the following terms:
You represent that your content, data collection practices, and advertising comply with all applicable regulations including GDPR, CPRA, CCPA, COPPA, CAN-SPAM, advertising laws, and platform requirements. If you use our Services to manage or monetize Facebook pages or other platform assets, you are responsible for ensuring that your content and practices comply with those platforms’ terms of service.
Publisher in a Box is not liable for revenue loss, platform actions, algorithm changes, advertiser volatility, API access revocations, data inaccuracies from third-party sources, AI tool outputs, technical outages, indirect damages, or lost profits. Our total liability is limited to the fees paid by you in the 12 months preceding the claim. This limitation applies regardless of the form of action, whether in contract, tort, strict liability, or otherwise.
You agree to indemnify and hold harmless Publisher in a Box, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your content, your use of our Services, your violation of these Terms, your violation of any third-party platform’s terms, or your violation of any applicable laws or regulations.
We may suspend or terminate your access for violations of these Terms, abuse, fraud, non-payment, or any conduct that we determine, in our sole discretion, to be harmful to our business, other users, or third-party platform relationships. You may terminate your use of our Services at any time by contacting us at grow@publisherinabox.com. Termination does not relieve you of any payment obligations for Services already rendered.
These Terms are governed by the laws of the State of Wyoming. Any disputes shall be resolved exclusively in the courts of Sheridan County, Wyoming.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy and any separate written agreements (e.g., consulting contracts, partnership agreements), constitute the entire agreement between you and Publisher in a Box regarding the use of our Services.
